Terms of Service

These Terms of Service ("Terms") govern your use of the Bio-Scry mobile application ("the App") and this website (together, "the Service"), provided by Nurtli ("we", "us", "our"). By downloading, accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What Bio-Scry is

Bio-Scry is an on-device genomics toolkit for research and education. It assembles, annotates, analyses and types genomic sequence data locally on your device. It is a software tool that produces computational predictions; it is not a laboratory service and does not provide professional advice.

2. Research and educational use only — not a medical device

The Service is provided strictly for research and educational purposes. It is not a certified diagnostic device and has not been cleared or approved by any regulatory authority. Its outputs are computational predictions from sequence data and must not be used as the sole basis for any clinical, diagnostic, treatment, or other health-related decision, nor for any decision where failure could lead to injury, loss, or harm. Any genotype-based prediction (for example, resistance or virulence screening) is not a substitute for validated laboratory testing. You are responsible for independently verifying any result before relying on it.

3. Licence to use

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the Service for your own lawful research and educational purposes. Your use of the App is also governed by Apple's Licensed Application End User License Agreement (the "Standard EULA"), and where these Terms and the Standard EULA conflict as to the App, the more protective provision for the end user applies unless prohibited by law.

4. Acceptable use

You agree not to:

  • use the Service in violation of any applicable law or regulation, or to process data you are not authorised to process;
  • reverse-engineer, decompile, or attempt to derive source code, except to the extent this restriction is prohibited by applicable law;
  • resell, sublicense, or commercially redistribute the Service or its bundled databases as a standalone dataset;
  • use the Service to make clinical or diagnostic decisions, or represent its outputs as diagnostic;
  • interfere with or attempt to circumvent the security or intended operation of the Service.

5. Subscriptions (Bio-Scry Pro)

Certain features are offered through an optional paid subscription ("Pro"). Subscriptions are sold and billed through the Apple App Store and are subject to Apple's terms. Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period, and your account is charged for renewal within 24 hours of the period's end. You manage or cancel your subscription in your App Store account settings; deleting the App does not cancel a subscription. Prices are shown in the App and may vary by region. Except where required by law or Apple's policies, payments are non-refundable.

6. Your data

The Service processes your sequence data on your device. We do not operate a server that receives your reads, assemblies, or results, and we do not collect them. You are solely responsible for the data you choose to process and for maintaining your own backups. See our Privacy Policy for details.

7. Third-party software and reference data

The Service incorporates open-source software and bundles public reference databases that remain the property of their respective authors and are used under their applicable licences. Attributions and licences are listed in the App's Licenses screen and, in summary, on our Acknowledgements page. Reference databases are provided "as is" by their sources; we make no warranty as to their completeness or currency.

8. Intellectual property

The Service, including its software, design, text, and branding (excluding third-party components and your own data), is owned by Nurtli and protected by intellectual-property laws. These Terms grant you no rights in our trademarks or branding.

9. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any result will be accurate, complete, or reliable. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

10. Limitation of liability

To the maximum extent permitted by law, Nurtli and its contributors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or relating to your use of (or inability to use) the Service, even if advised of the possibility of such damages. To the extent liability cannot be excluded, our total aggregate liability is limited to the amount you paid us for the Service in the twelve months preceding the claim, or, where you paid nothing, to the sum of US $50. Nothing in these Terms limits liability that cannot be limited by law.

11. Changes to the Service and these Terms

We may modify, suspend, or discontinue any part of the Service at any time. We may also update these Terms; when we do, we will revise the "Last updated" date above, and material changes will be reflected in the App or on this page. Your continued use after changes take effect constitutes acceptance of the revised Terms.

12. Governing law

These Terms are governed by the laws of England and Wales, without regard to conflict-of-laws rules, and the courts of England and Wales will have exclusive jurisdiction, except where mandatory consumer-protection laws of your country of residence provide otherwise.
